Why this letter, and why free
Section 16(2) of the Occupational Health and Safety Act lets the chief executive assign duties to a named person in writing. It is the item most often missing from a South African employer's file, and it is the one with a named person's exposure attached to it. The file has always been legally required to exist. We make the first part of it exist properly, and you decide what happens to the rest.
What you receive
The section 16(2) assignment letter and the section 16(1) acknowledgement. Where your site has them, the section 17 representative designations and the first aider designations. Each letter cites its provision and its term, carries your letterhead, and arrives as one pack with a cover and an index. A twenty-minute recorded handover is offered, never required, and it becomes the record that the assignment was consulted and understood, which is the part an inspector asks about.
What we need from you
One reply: registered name and number, the site address and headcount, the chief executive, the person to be assigned and the date it should run from, any elected representatives and first aiders with certificate dates, your logo or letterhead, and who will sign. A one-page mutual non-disclosure comes with the reply and expires on day ninety, when your information is deleted unless you ask us to keep it.
What it does not cover
Registers, the risk assessment, incidents, contractors, COIDA and policy. Those are what an inspector spends the hour on, and they are a separate conversation. On a construction site the principal contractor carries the safety file; this offer is for the firm as an employer of its own staff.
